Billing Terms:

• Subscriptions are billed in advance on a monthly or annual basis
• Payment is due upon subscription activation or renewal
• All fees are non-refundable except as required by law or specified in our Refund Policy
• We reserve the right to modify pricing with 30 days notice to existing subscribers
• Failure to pay may result in service suspension or termination

You may cancel your subscription at any time. Upon cancellation, you will continue to have access through the end of your billing period.

Usage limits and features vary by plan tier. Exceeding plan limits may result in additional charges or service restrictions.

5. Intellectual Property

Your Content: You retain all rights to content you generate using Harbor. We claim no ownership over your output. You are free to use, modify, distribute, and monetize content generated through the Service.

Our Platform: The Service and its original content (excluding user-generated content), features, and functionality are and will remain the exclusive property of Harbor. The Service is protected by copyright, trademark, and other laws.

License to Use Service: We grant you a limited, non-exclusive, non-transferable license to access and use the Service for your internal business purposes in accordance with these Terms.

Input Data: By providing input data, prompts, or source URLs, you grant us a limited license to process this information solely for the purpose of providing the Service.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Harbor does not warrant that:

• The Service will function uninterrupted, secure, or available at any particular time or location
• Any errors or defects will be corrected
• The Service is free of viruses or other harmful components
• The results of using the Service will meet your requirements
• Generated content will be accurate, complete, or fit for any particular purpose

You acknowledge that AI-generated content may contain inaccuracies and should be reviewed before publication. You are solely responsible for verifying the accuracy and appropriateness of generated content.

8. Limitation of Liability

IN NO EVENT SHALL HARBOR, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your access to or use of or inability to access or use the Service
• Any conduct or content of any third party on the Service
• Any content obtained from the Service
• Unauthorized access, use, or alteration of your transmissions or content

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

• Your violation of any third party right, including without limitation any copyright, property, or privacy right
• Content generated using your account

10. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

Upon termination:

• Your right to use the Service will immediately cease
• You will lose access to your account and stored data
• We may delete your data in accordance with our data retention policies
• You remain liable for all charges incurred prior to termination

You may terminate your account at any time by canceling your subscription through your account settings or by contacting us.

11. Governing Law

These Terms shall be governed and construed in accordance with the laws of the jurisdiction in which Harbor operates, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

12. Dispute Resolution

Any dispute arising from or relating to the subject matter of these Terms shall be finally settled by binding arbitration, except that either party may bring an action in court to enjoin infringement or other misuse of intellectual property rights.

You and Harbor agree that any arbitration shall be limited to the dispute between Harbor and you individually. You agree to waive any right to a jury trial.

13. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days notice prior to any new terms taking effect.

What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.

• Not circumvent usage restrictions or authentication mechanisms
• Maintain the security of your API keys
• Use the API only for lawful purposes
